This Acceptable
Use Policy is in place to protect our customers from deterioration in
service. Failure to read and agree to these terms means you are not able
to use our services.
All customers must agree to the following:
Content:
The services provided by us must be used for lawful purposes only. Transmission,
storage, or presentation of any information, data or material in violation
of any British law is prohibited. Copyrighted material, material we judge
to be threatening or obscene, or material protected by trade secrets and
other statutes are also not allowed. We are not responsible for any claims
resulting from the use of our service. Any sites that promote this are
also true for sites that promote any illegal activity or content that
may be damaging to our servers or any other server on the internet. Links
to such materials are prohibited. This also includes, but not limited
to Adult sites, pirated software, hacker programs/archives, MP3, and Warez
sites. We reserve full right to provide your details upon request from
any legal representatives or authorities.
Domains:
We must stress that we are not a domain registrar therefore we do not
have nominet tags or NIC tags this means domains can only be transferred
to us via nameservers to complete a full transfer you will require a domain
registrar. We can however provide this service if you contact us prior
to sign up however there is transfer charges involved. Sites come with
a free domain providing you slect you do not own a domain. We register
sites using a partner company. We do not place your details on the whois
output of the domain due to legal reasons however if you commit any sort
of illegal activity we reserve full right to provide the appropriate personals
your details. If you wish to have your details displayed upon the whois
output please contact us after sign up and we will do this for you.
Commercial Advertising- Email (SPAM):
Spamming, or the sending of unsolicited email, from our servers or using
an email address that is maintained by us is STRICTLY prohibited and will
qualify your site for immediate deactivation with no refund. eUKhost will
be the sole arbiter as to what constitutes a violation of this provision.
Server abuse:
Any attempts to undermine or cause harm to any of our servers is strictly
prohibited. We hold no responsibility for the use of our clients' accounts.
Any account that abuses resources and actions are not taken to desist,
calls for immediate deactivation without any refund. Any site using what
we deem to be using excessive CPU cycles or any resources that cause strain
to other sites may also be offered new terms. Although we offer 99.9%
up time we can not fully guarantee this, this is due to updates and upgrades
we carry out upon our servers to maintain them to a high degree of quality.
99.9% up time is based upon our server reports for last year (2002).
Abuse:
If any client is in any way disrespectful towards any member of the eukhost
staff we have full right to remove them from our services without any
refund.
Bandwidth:
If the bandwidth limit opposed on your account is reached, we will discuss
with the customer what shall be done next. If the customer does not wish
to purchase extra bandwidth and continues to exceed their limit, the account
shall be suspended until the customer has taken further measures to ensure
the limit is not exceeded again. The account will be reactivated the following
month.
Back-ups:
Back-ups must be made by clients. We are now un able to provide daily
back ups as a result of the amount of resources sites take up therefore
it is your best interest to make back ups of your site on a regular basis
in case of any unlikely server break downs.
Billing:
If paying by cheque, please allow 5 days for cheque to clear and for us
to open account. If paying via postal orders or cash your account will
be set up the same day.
Security:
You are responsible for any misuse of your account, even if the inappropriate
activity was committed by a friend, family member, guest or employee.
Therefore, you must take steps to ensure that others do not gain unauthorized
access to your account. In addition, you may not use your account to breach
security of another account or attempt to gain unauthorized access to
another network or server.
Your password provides access to your account. It is your responsibility
to keep your password secure.
Sharing your password and account access with unauthorized users is prohibited.
You should take care to prevent others from using your account since you
will be held responsible for such use.
Attempting to obtain another user's account password is strictly prohibited,
and will result in termination of service.
You must adopt adequate security measures to prevent or minimize unauthorized
use of your account.
You may not attempt to circumvent user authentication or security of any
host, network or account. This includes, but is not limited to, accessing
data not intended for you, logging into or making use of a server or account
you are not expressly authorized to access, or probing the security of
other networks. Use or distribution of tools designed for compromising
security is prohibited. Examples of these tools include, but are not limited
to, password guessing programs, cracking tools or network probing tools.
You may not attempt to interfere with service to any user, host or network
("denial of service attacks"). This includes, but is not limited
to, "flooding" of networks, deliberate attempts to overload
a service, and attempts to "crash" a host.
Users who violate systems or network security may incur criminal or civil
liability. eUKhost will cooperate fully with investigations of violations
of systems or network security at other sites, including cooperating with
law enforcement authorities in the investigation of suspected criminal
violations.
Cancellation:
You may ask for a refund within 30 days of opening your account providing
you have a full reason for doing so. If your domain came free with your
account then the total of 8 UK pounds is non refundable therefore you
will be issued a refund to the total you piad - 8 UK pounds to cover the
domain costs. We reserve the right to refuse refunds if your reason is
deemed not acceptable by our management.
Refusal of Service:
We reserve the right to refuse, cancel, or suspend service at our sole
discretion.
These terms may be modified at any time and without notice. All users
previous and new are always subject to the newest terms posted here at
all times
